Merch Designer is an AI-powered design generation platform that creates artwork suitable for print-on-demand merchandise, specifically optimized for Amazon Merch on Demand. The Service allows users to generate, download, and use designs for commercial purposes based on their subscription tier.

3. User Accounts

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Accept responsibility for all activities under your account

4. Subscription and Payments

The Service offers various subscription tiers with different features and design limits. By subscribing to a paid plan, you agree to:

  • Pay all applicable fees for your chosen subscription tier
  • Provide valid payment information
  • Accept automatic renewal unless cancelled before the billing period ends
  • Understand that unused credits do not roll over to the next billing period

All plans include a 30-day money-back guarantee. Refund requests must be submitted within 30 days of the initial purchase.

5. Intellectual Property and License

For paid subscription tiers (Starter, Plus, and Premium):

  • You receive a perpetual, worldwide, non-exclusive license to use generated designs for commercial purposes
  • You may sell products featuring the designs on Amazon Merch on Demand and other platforms
  • You may not resell or redistribute the designs as digital files or design templates
  • You may not claim copyright ownership over AI-generated designs

For Free tier users, designs are provided with watermarks and are for evaluation purposes only. Commercial use of Free tier designs is not permitted.

6. Prohibited Uses

You agree not to use the Service to:

  • Generate content that infringes on trademarks, copyrights, or other intellectual property rights
  • Create designs containing hate speech, discriminatory content, or illegal material
  • Generate content depicting real individuals without their consent
  • Attempt to reverse-engineer or exploit the AI generation system
  • Share account credentials or transfer your subscription to others
  • Use automated systems or bots to access the Service

7. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that generated designs will be unique, error-free, or suitable for any particular purpose. Users are responsible for ensuring their designs comply with Amazon Merch on Demand policies and applicable laws.

8. Limitation of Liability

To the maximum extent permitted by law, Merch Designer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of the Service.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms of Service. Upon termination, your right to use the Service will immediately cease. You may cancel your subscription at any time through your account settings.
